One of the Mongolian daily newspaper, Udriin sonin's columnist, Mr. Sha. Batbayar was detended about 3 hours in the Sukhbaatar District Police Department and detained 40 minutes with a force after his work on Monday, November 3, 2003 with an unknown reason. Relatively, he held a Press Conference in three days and warmed to the journalists that "I am holding the Conference not to announce that I have been detended, I would like to warm to people, specially to journalists to be careful. Otherwise, such a case which has been happened with me perhaps would be happened and repeated", he explained. Detainees being with him in the same room said to him that "The Police detain people during weekends after working hours being finished on Fridays with any reason. Therefore, the detainees have not any other way to be detained because it is not possible to contact the Prosecutor till next mornings".
As his notice, it might depend on the provision of the newly adopted Code of Administrative Responsibility that "In a case opposing a policeman's requirements, the opposer shall be detained without the permission of the Prosecutor for 14 days or 2 weeks considered as a rowdy". This provision shall not be related to the Prosecutor's permission to arrest offenders and violators. Relatively, Mr. Sha. Batbayar also reminded for the others not to oppose policemen if they would demand.
Before this, he was investigated a year ago regarding a publication which he wrote and about MP-s Ts. Shiirevdamba, T. Gandi, D. Arvin. The reason to detain him that a month measure had been conducting on the "Reveals of fugitives" during that time. "Any law has not a category "fugitive", has only a category "desertion". It has not a way to explain correctly their action to name a person having local administrative and permenant address living in which and working and visited the Police Department 10 times before the action" he noticed and explained his opinion that it was an action of middle officials of Polices and legislative organizations to behave themselves arbitrarly violating laws and regulations.
As the "Daily news" newspaper noticed, that day when Mr. Sha. Batbayar was detained, the Human Rights Support National Program was adopted and the Mr. Ts. Sharavdorj, the Chairman of the Law Standing Committee, Mr. S. Tserendorj, the chairman of the Human Rights National Committee held a press conference relatively. In the Program, it was emphasized that some provisions relatively to human rights should be implemented in 10 and 15 years and the press and information means should not been to be dependent from any body. However this action fearing and detaining a journalist had expressed how was the fulfillment of laws and regulations for human rights and press freedom. "We, journalists permenantly air that the action to furl the press freedom and to invade journalists rights is increasing day by day. In a case not to gather our voice and to unite our strength together, our condition would be worsening more and more. This action reminds us", they said.
